2. Eligibility and verification
- Maintain a valid legal identity, tax registration and all permits or declarations required for each activity.
- Maintain appropriate commercial and liability insurance and provide evidence on request.
- Use trained, legally authorized staff and guides, safe equipment and documented emergency procedures.
- Promptly disclose investigations, license changes, serious incidents or facts that could affect traveler safety or trust.
- Permit WTG to verify submitted information and suspend listings while verification is incomplete.
3. Listings and availability
The provider grants WTG a worldwide, non-exclusive, royalty-free license during the relationship to host, edit for clarity, translate, distribute and market provider content and marks for the listings. The provider retains ownership and warrants it has all necessary rights.
- Keep descriptions, photos, inclusions, restrictions, meeting details, accessibility, prices, taxes and availability accurate.
- Identify whether the provider is acting as a professional trader or in another capacity permitted by law.
- Honor confirmed reservations and the full price and balance shown to the traveler.
- Do not substitute a materially different service without traveler consent.
- Do not manipulate reviews, rankings, availability or pricing.
4. Deposits, fees and provider balance
For each approved listing, WTG and the provider will record the full traveler price, the reservation deposit collected by WTG and the balance collected directly by the provider. The deposit may represent WTG's marketplace compensation or another agreed amount, as documented in the provider's commercial schedule. WTG does not collect the provider balance unless the parties later activate a separate written payment arrangement.
- The provider is responsible for receipts, taxes and compliance relating to amounts it collects directly.
- No additional mandatory charge may be imposed unless disclosed to and accepted by the traveler before booking.
- The provider must not misrepresent WTG's deposit as payment of the full experience price.
- Any refunds allocated to the provider must be paid promptly using the agreed method.
5. Booking response and service
- Respond within the confirmation window configured in the portal.
- Send accurate meeting, pickup and preparation instructions.
- Protect traveler contact information and use it only for the reservation, safety, support and other lawful consented purposes.
- Provide the experience with reasonable skill, care, professionalism and without unlawful discrimination.
- Maintain an emergency contact while travelers are participating.
- Report a serious incident to WTG promptly after handling immediate safety needs.
6. Cancellations and complaints
The provider must follow the cancellation policy accepted for each listing. Provider cancellations, unavailability, material misdescription or service failure may require the provider to refund amounts it collected, reimburse WTG for traveler remedies caused by provider breach, and cooperate with support investigations. WTG will give the provider a reasonable opportunity to respond except where urgent safety or fraud action is needed.
7. Data protection and security
Each party acts as an independent controller for personal information it receives for its own purposes. The provider will use traveler data only as necessary to confirm, perform and support the reservation or as otherwise lawfully authorized; apply appropriate safeguards; limit staff access; honor applicable privacy rights; and notify WTG without undue delay of a breach affecting WTG travelers.
8. Compliance and conduct
- Comply with consumer, tourism, labor, environmental, accessibility, anti-corruption, sanctions and tax laws that apply.
- Do not divert a WTG-originated booking to avoid agreed marketplace compensation.
- Do not send unsolicited marketing to travelers without a lawful basis.
- Do not use WTG branding outside approved materials or imply employment, certification or endorsement beyond the listing status actually granted.
9. Suspension and termination
Either party may end the relationship on 30 days' written notice, while honoring existing reservations unless otherwise agreed. WTG may immediately pause or remove listings for safety, fraud, repeated service failure, expired credentials, legal risk or material breach. Provisions concerning payments, data, intellectual property, liability and disputes survive as needed.
10. Responsibility, indemnity and limits
The provider is responsible for its personnel, subcontractors, equipment and performance. To the extent permitted by law, the provider will defend and indemnify WTG against third-party claims arising from the provider's breach, negligence, unlawful conduct or infringement, except to the extent caused by WTG. Neither party excludes liability that cannot legally be excluded. WTG's aggregate contractual liability will not exceed marketplace amounts retained by WTG for that provider during the preceding six months, except for fraud, willful misconduct, gross negligence or non-excludable liability.
11. Law, changes and acceptance
Costa Rican law governs this Agreement and the competent courts of Costa Rica have jurisdiction, unless a signed commercial schedule provides a lawful alternative. Material changes will be notified in advance. Electronic acceptance records the provider, accepting user, version and time; the accepted version remains available in the provider account.
